Developer David Lieberman agrees to Brownfield guidelines

The Belleville Downtown Development Authority and developer David Lieberman came to terms with a development and reimbursement agreement on Tuesday night at a special meeting.

The Belleville City Council had to first approve the addition of the Amerman Lumber Company property, the future site of the Belle Park Condominiums, to the boundaries of the DDA.
In the pact, Lieberman agreed to incur demolition and environmental response, infrastructure and site preparation costs for activities constituting eligible activities on the property beyond the normal costs for development of the developer's improvement because of the property's former industrial and obsolete status.
Lieberman will develop the property under the Brownfield Redevelopment Authority guidelines. A Brownfield project oversees the clean up of former industrial sites to be reconverted into residential properties.
The DDA agreed to reimburse Lieberman from existing funds for certain items such as water, sewage and lighting. All permits must be filed and work completed to the satisfaction of inspectors and the DDA before any monies are exchanged.
The equity interest and indemnity of the DDA is protected in the agreement.
Sect. 5 states " The developer shall cooperate with the DDA in executing a martgage against the property to protect the equity interest of the DDA in the payments made and the improvements constructed on the property for which the developer receives reimbursements from the DDA.
The DDA mortgage shall be in an amount not to exceed the actual payments by the DDA to the developer, and will take a secondary position to the actual lender."
The agreement also states that the developer will indemnify and release the DDA from any and all losses, demands, claims, actions, damages and liabilities due to the environmental condition of the site.
Belle Park is a proposed 61 unit apartment project on the site of the former Amerman Lumber Company site on E. Columbia.
Lieberman has agreed to move the old brick home on the property rather than tear it down.
Work could begin next year with a possible completion date of Spring, 2007.
